SwiftChat AI Bot Feature Information Notice

This SwiftChat AI Bot Feature Information Notice ("Notice") explains how personal data is processed when Users interact with the AI Bot features made available through SwiftChat. By accessing or using the AI Bot feature, the User expressly acknowledges, accepts, and agrees to be bound by the terms of this Notice and consents to the processing of their personal data as described herein.

This Notice forms part of, and should be read together with, the SwiftChat Terms of Service and SwiftChat Privacy Policy. The SwiftChat Privacy Policy continues to govern the collection, use, storage and protection of personal data across the SwiftChat platform.

1.About SwiftChat AI Bot Feature

1.1. AI Bot is an artificial intelligence-enabled feature available within SwiftChat that allows Users to interact with designated agents through supported modes including text, voice and video.

1.2. Depending on the AI Bot experience being used, Users may communicate with an AI Bot, upload permitted files, participate in voice or video interactions, receive AI-generated responses, access summaries of interactions and use other related features.

2. Personal Data Processed Through AI Bot

2.1. For the purpose of providing AI Bot features and services, SwiftChat may process the following categories of personal data:

a. Text messages, prompts, questions and responses;

b. Conversation history associated with AI Bot interactions

c. Voice communications and voice interaction data;

d. Video communications and video interaction data;

e. Transcripts generated from voice or video interactions;

f. User-uploaded images, documents and other content voluntarily shared through AI Bot;

g. User profile information already available within SwiftChat, including usernames where required to facilitate interactions;

h. Session-related information necessary to establish, maintain and secure AI Bot interactions; and

i. Contextual information retained to maintain continuity across interactions.

3. Purpose of Processing

3.1. Personal data processed through AI Bot is used solely for one or more of the following purposes:

a. Providing AI Bot functionality requested by the User;

b. Understanding and responding to User queries;

c. Facilitating text, voice and video interactions;

d. Generating transcripts and summaries of interactions;

e. Maintaining continuity between User interactions where memory features are enabled;

f. Detecting, preventing and investigating misuse, abuse, fraud, security incidents or violations of applicable terms;

g. Maintaining the safety, reliability and integrity of the AI Bot feature and its services;

h. Complying with legal, regulatory and contractual obligations; and

i. Responding to User support requests, grievances and lawful requests.

3.2. SwiftChat shall process personal data only for purposes that are lawful and connected with the operation of AI Bot services.

4. AI Bot Memory and Continuity Features

4.1. Certain AI Bot experiences may retain contextual information from previous interactions to provide continuity across sessions and improve the relevance of future responses. Such information is used solely to:

a. Maintain conversational continuity;

b. Avoid repetitive collection of the same information; and

c. Personalize interactions requested by the User.

4.2. It is hereby clarified that AI Bot memory is not used for targeted advertising, behavioural advertising or commercial profiling of Users.

4.3. Where memory-sharing functionality is enabled by an institution, programme owner, customer or authorized administrator, contextual information may be made available across designated AI Bot experiences for the purpose of providing a seamless User experience.

5. Voice, Video and Transcripts

5.1. Where a User makes use of voice or video functionality:

a. Communications may be processed in real time to provide the requested interaction;

b. Voice and video interactions may be converted into text transcripts;

c. Transcripts may be used to facilitate the interaction, generate summaries, maintain continuity across sessions and support User-requested functionality.

6. Recording of Sessions

6.1. The AI Bot feature does not record voice and video sessions by default.

6.2. If recording functionality is introduced or enabled for a particular AI Bot experience, SwiftChat shall provide appropriate notice and obtain consent where required under applicable law before recording begins.

6.3. Unless separately disclosed and consented to, recordings shall not be used for training artificial intelligence models.

7. Functionality

7.1. AI Bot functionality may be made available in educational, skilling, learning, career guidance, government-supported or other child-accessible environments.

7.2. Where required under applicable law, SwiftChat shall obtain verifiable consent from a parent or lawful guardian, or rely upon authorization provided through a school, educational institution, government authority or other legally authorized entity (as the case maybe) before processing the personal data of a child.

7.3. SwiftChat does not knowingly undertake behavioural monitoring, targeted advertising or advertising-directed profiling of children through its AI Bot feature.

8. Retention of Personal Data

8.1. Personal data processed through AI Bot shall be retained only for as long as is necessary to:

a. Provide AI Bot functionality;

b. Maintain continuity of services;

c. Fulfil legal, regulatory, contractual or audit obligations;

d. Protect the safety, security and integrity of the platform;

e. Resolve disputes and enforce applicable agreements.

8.2. Retention periods may vary depending upon the nature of the data and the specific AI Bot feature being used.

9. Safety Guardrails

9.1. As an additional safety layer, SwiftChat implements a moderation and guardrails framework (“Framework”) for AI Bot feature that reviews User inputs before processing. This system helps prevent the handling of harmful, sensitive, or inappropriate content, including attempts to share personal data, thereby supporting overall data protection and platform safety.

9.2. The Framework is designed to block any content that:

a. Promotes, glorifies, or provides instructions for illegal, harmful, violent, or dangerous activities, including drugs, alcohol, gambling, self-harm, or harm to others

b. Contains explicit sexual content, pornography, graphic violence, or other obscene or harmful material.

c. Involves impersonation of real individuals or attempts to bypass or reveal internal system instructions or safeguards.

d. Uses abusive, hateful, or offensive language or attempts to request or share sensitive personal information such as passwords, addresses, or phone numbers.

e. Contains executable code or requests to run software that may pose technical or security risks.

9.3. The Framework may also restrict content that:

a. Facilitates cheating, plagiarism, or academic dishonesty.

b. Involves dating, romantic, or inappropriate personal relationship discussions unrelated to education.

c. Requests professional medical, legal, or financial advice beyond general educational explanations.

d. Raises controversial or highly sensitive topics without a clear educational context

10. Rights of Users

10.1. Users may exercise rights available, including rights relating to:

a. Access to information regarding processing of personal data;

b. Correction, completion or updating of personal data;

c. Erasure of personal data, where applicable;

d. Withdrawal of consent, where processing is based on consent;

e. Grievance redressal.

10.2. Requests relating to AI Bot interactions, transcripts, stored contextual information or other AI Bot-related personal data may be submitted through the grievance mechanism identified in the SwiftChat Privacy Policy.

11. Transparency

11.1. AI Bot responses are generated using artificial intelligence systems.

11.2. While SwiftChat seeks to provide useful and relevant responses, Users acknowledge that AI-generated outputs may occasionally be inaccurate, incomplete or outdated. Users should exercise independent judgment before relying on AI Bot generated content.

12. Grievance Redressal

12.1. Any grievance, complaint or concern relating to processing of personal data through AI Bot functionality may be submitted to the Grievance Officer identified in the SwiftChat Privacy Policy.

12.2. SwiftChat shall address such grievances in accordance with applicable law and internal grievance handling procedures.

13. Updates to this Notice

13.1. SwiftChat may update this Notice from time to time to reflect changes in AI Bot functionality, applicable law, technology or operational requirements.

13.2. Updated versions shall be made available through SwiftChat and shall become effective in accordance with applicable law.
